Stephanie Classmann PhD Candidate, London School of Economics and Political Science Aufenthalt am Forschungskolleg Humanwissenschaften: September 2020–Juni 2021Forschungsthema am Forschungskolleg Humanwissenschaften: »Criminal Law as Modus Vivendi – A Realist Rebuttal to Liberal Theories of Criminalisation«Projektbeschreibung: My project aims to expose the overly moralistic tenor and political naiveté of the liberal criminalisation debate, and to formulate the groundwork for a more inclusive conceptual alternative. Drawing attention to the mechanism of political representation and the notion of modus vivendi, in particular, I argue that legitimate government and, by extension, the legitimacy of the criminal law is measured by its capacity to recognise and respond to a plurality of interests and ideas, by the functional integrity and effective operation of its procedures, and by the institutional articulation of its impermanence. Thus (re-)conceived, criminal law presents itself, in its entirety, as a purely coordinative instead of morally condemnatory enterprise – a necessary and significant conceptual shift, I argue, that will prove powerfully illuminating for a more functional and sharp definition of both the interests that warrant state protection and the criminal law’s boundaries with other modes of regulation. Ihre Arbeit wird von Nicola Lacey und Peter Ramsay betreut. Vor Beginn ihrer Promotion war sie als Dozentin für Strafrecht und Juristische Methoden & Recherche an der University of Sydney Law School in Australien angestellt, und als freiwillige Mitarbeiterin für das Sydney Exoneration Project ‚Not Guilty‘ tätig. Stephanie unterrichtet Strafrecht, Grundlagen des Rechts, und Juristische Methoden & Recherche an der LSE. Für das akademische Jahr 2020-21 wurde sie zur Redaktionsassistentin der LSE Law Working Paper Series ernannt.Stephanie erhielt ihren LL.M. von der University of Sydney, und hat das deutsche juristische Staatsexamen am Oberlandesgericht Düsseldorf abgelegt. Als Alumna der Heinrich-Heine-Universität Düsseldorf steht sie in engem wissenschaftlichen Kontakt mit Prof. Dr. Karsten Altenhain, an dessen Lehrstuhl für Strafrecht, Wirtschaftsstrafrecht und Medienrecht sie von 2011 bis 2016 als wissenschaftliche Mitarbeiterin tätig war, und seit 2018 regelmäßig für einzelne rechtsvergleichende Forschungsprojekte herangezogen wird.
